This Terms and Conditions will apply to all visits to and use of the site as well as the content, information, recommendations, products and / or services offered to you on or through the site.

By accessing and using the site, you accept these Terms and Conditions in full, in addition to any other law or regulation that is applicable to the site and the internet. If you do not agree to these Terms, please do not use the Web Site and exit immediately.

By accessing and/or using this site, the user admits having read and understood these General Terms and Conditions and the Privacy Policies and accept and agrees with them, without limitation or qualification, and acknowledge that any other agreements between the user and ANCORA SM are superseded with respect to this subject matter. If the user does not agree to accept these General Terms and Conditions and the Privacy Policies without limitation or qualification, please exit the site and cease all access to and use of the site.

Each provision of these Terms and Conditions shall be construed separately and independently of each other. The customer will be responsible for the shipping, handling and insurance charges for the products and/or services that he purchases in ANCORA SM (except when there is free shipping method is available), as well as all sales taxes, value added taxes and any other taxes and charges that may be incurred for each offer of purchase accepted. All taxes caused by the purchase will be settled from the moment the customer makes his offer to purchase on this site, and therefore he can know the exact value that he must pay in favor of ANCORA SM, which will include all the concepts mentioned.

If your order has any alerts, ANCORA SM will contact the customer to solve the requirement. The customer has a maximum of 24 hours to respond to the mail. ANCORA SM is not and will not be responsible if, after this time, the order generates additional expenses, is returned to origin or eventually lost.

Changes of address, city, country or other additional information that affects the value of the initial shipment paid at the time of purchase, are entirely responsibility of the customer, therefore, ANCORA SM will not assume any extra charge generated in the order. If for any reason additional expenses are incurred, ANCORA SM will notify the customer to pay any fee or expense generated prior to the delivery of the order.

The ANCORA SM website aims to display product images as accurately as possible. However, we cannot guarantee that the color you see matches the color of the product, since the color display depends in part on the monitor you are using.

 The published images are reference images so there may be differences between the product received versus the reference product in the website, these are products with a manual process and mass production therefore they may have changes in the position of the prints, color changes based on batch, fabric texture, etc.

ANCORA SM may, in its sole discretion, limit or cancel the amounts purchased per person, per user or per order. In addition, ANCORA SM reserves the right to refuse any orders you make. These restrictions may include orders placed by the same ANCORA SM website account, the same credit/debit card and orders with the same shipping or billing address.

Shipments and deliveries

Due to the health emergency declared by the national government with respect to COVID-19 and as part of our corporate responsibility policy, we adopt the pertinent measures to avoid the contagion and spread of the virus.

ANCORA SM is subject to restrictions imposed by the national government, for this reason, customer service hours in our digital channels could be changed without prior notice, presenting variations in ANCORA SM’s operations.

Shipments could present delays due to said measures, in which ANCORA SM disclaims responsibility as it corresponds to and depends on logistics, administrative, commercial provisions of third parties (suppliers) and the national government. Please allow 3-4 business days in order processing.

ANCORA SM has coverage in the whole United States Territory and most International territory

When you select the city, state and the type of shipment, ANCORA SM will automatically calculate the shipping cost. The freight/shipping cost will appear as an additional item to the selected products and can be clearly identified before finalizing your order.

The deliveries in the USA territory will be operated under several shipping methods UPS and FEDEX offer. It goes from standard ground services to next day services. Standard ground services will take from 2-5 business days to deliver. All domestic shipments will be made through the logistics operator “UPS” or FEDEX. It all depends on where the product is being shipped taking into consideration ANCORA SM has warehouses in the US and outside the US. The shipping process starts from the moment the product leaves ANCORA SM warehouses and ends when it reaches the destination address through the logistics operator. ANCORA SM shall not be liable for delays that occur with the delivery of orders, which are solely due to the logistic operator, including but not limited to meteorological conditions, interruptions in service or any other conditions.

The client must be attentive to his email or telephone number registered in the order, since FEDEX OR UPS operation team can contact the client at any time to make the delivery of his order effective. ANCORA SM is not responsible for extra costs that are generated by returned orders or orders that are abandoned by the logistic operator. Any of these costs will be charged to the client in order to make its delivery effective.

National orders are processed and deliveries as soon as the purchase payment is completed at www.ancoraswimwear.com/us. Orders placed after 2:00 PM will be processed and delivery the next business day. We do not ship on weekends or holidays.

The estimate delivery time for standard services is about 2 to 5 business days from the delivery (No available for Alaska, Hawaii, USVI)

The contracted logistics provider makes deliveries only on business days from Monday to Friday (Excludes Holidays) from 8:30 AM to 6: 00 PM.

ANCORA SM does not assume any responsibility in case the logistics operator does not comply with the estimated delivery date since its operation is totally independent. ANCORA SM will only be responsible for the customer’s purchase when ANCORA SM does not comply and has not made the shipment on the date agreed at the time of purchase.

Free Shipping is applied on all shipping in our entire online store. Our free ground shipping offer cannot be applied to purchases being shipped to Alaska, Puerto Rico, Hawaii, US Territories or Virgin Islands. Free shipping will go out in standard ground FEDEX service. If you wish to upgrade your shipping method, you must pay for any additional costs that are available in the moment of check out. Free ground shipping cannot be applied to previous purchases. Orders will be processed and shipped during the regular business days of Monday through Friday. Address verification may delay delivery of your order. Please allow an additional 5-10 days for sale campaigns, Black Friday & Cyber Monday sales.

ANCORA SM makes international shipments to any part of the world where you are if your country is under the country dropdown menu in the moment of check out. The deliveries outside the United States territory will be sent through the logistic operator DHL or FEDEX.

The client must be attentive to his email or telephone number registered in the order, since FEDEX OR UPS operation team can contact the client at any time to make the delivery of his order effective. ANCORA SM is not responsible for extra costs that are generated by returned orders or orders that are abandoned by the logistic operator. Any of these costs will be charged to the client in order to make its delivery effective.

For international shipments only the standard mode is available, for which the delivery time is up to 5 business days counted from the delivery depending on how far the country is you are buying from. However, delays may occur for customs purposes.

Please note, all international packages may be subject to duties and taxes and is not included in the price at checkout. ANCORA cannot reimburse customs in any capacity and is not liable for reimbursing or refunding customs. Custom fees are client’s responsibility.

These fees are charged by the county of import, so we have no control over any customs/duty’s fees associated with your order. The limits for duty-free packages are established by your local customs authorities. International free shipping is eligible on orders over $400. Free shipping will go out in FEDEX standard international service. Free ground shipping cannot be applied to previous purchases. Confirmation order status

ANCORA SM will send the user an email with the confirmation of his purchase, specifying the units purchased, the type of shipment and/or any other requested service.

If you have made the payment of your purchase through the platform PayPal or Stripe, you will receive an email from them with confirmation and payment values.

ANCORA SM will send the user an email with the confirmation that his order has been delivery with the logistics operator.

ANCORA SM through its logistics operator will take the products purchased to its destination. The user can verify the guide number through the logistic operator’s page and you can visualize the status of your guide maximum up to 24 hours after the guide is issued. This is due to updates on the pages of each operator.

ANCORA SM will send the user an email with the confirmation that the logistic operator has delivered the product at the final destination and giving a message of appreciation to its users for the purchase made.

When a certain size or reference option does not show up in the menu, it means that we are currently sold out of that specific selection you are looking for. If you do not see the size you are looking for, please check back frequently as we are receiving inventory in a regular basis.

The PRE ORDER mode on a product indicates that the product is not available at the time of purchase, therefore it will be delivered on the date indicated on the product at the time of size selection and prior to adding to the cart. ANCORA SM does not assume any responsibility for non-observance of that information, nor does it acquire any commitment in requesting delivery in advance of the date indicated at the time of purchase at the request of the client.

The delivery date may be modified by ANCORA SM at any time in the event that it cannot initially comply with the agreed shipping date. ANCORA SM will notify by email the date change and the new estimated delivery date.

The products purchased in PRE-ORDER enter to be produced especially for the user or buyer. ANCORA SM may change the shipping date a maximum of two times. In the event that the products in PRE-ORDER cannot be delivered on the estimated second date, the client may choose to exchange the product and/or request a refund of their money if delivery date has been modified more than two times. Money returns will ONLY be accepted when ANCORA SM cannot meet the second date agreed.

ANCORA SM does not keep your credit card information on file.  If there is an order change, sometimes we cannot make changes to your order without contacting you for your credit card information if a price adjustment is needed. A PayPal link will be sent to the client if needed to pay for extra costs.

Returns and guarantees policy

This Returns and Exchanges Policy applies to all purchases made through the website www.ancoraswimwear.com/us.

For US customers, a prepaid return shipping label will be provided at no charge to return your merchandise. Please try on garments over underwear. Online purchases made through the Site are valid for exchange, credit, or refund within 15 days from the ship date.

ANCORA SM will refund or exchange an item, provided that it has not been damaged, soiled, washed, altered or worn and that all labels and tags are attached. Merchandise must have all tags and liners attached and returned in original packaging. Due to health regulations, styles that are soiled, worn, damaged or laundered will not be accepted. It is ANCORA SM discretion to decide if the returned suit has been soiled. If a suit is determined to be soiled, it will be returned to the customer at the customer’s expense.

Please note that products on sale are 30% off or over, are final sale. Quantities are limited and are not eligible for exchange, refund or store credit. If you have a question about the sizing of a sale suit, please call customer service at [email protected] or [email protected]. Special collections and designer collaborations may be subject to a return policy, that may differ from our standard return policy above.

At this moment we only accept returns via email within the first 15 days from your ship date.

  3. Box up your items with the original packaging. Be sure to remove any existing labels from the packaging.
  4. Place the pre-printed return label on the outside of your package. Please note that the return label is pre-paid, therefore, you will not be responsible for the return shipping cost.
  5. Drop off at your package at your nearest USPS office.
  6. Please allow up to 10 business days for your return to be processed once we received it.

For international customers, no free return shipping label will be provided. Customer must send back the product(s) at ANCORA facilities and is customer responsibility to assure that the product is returned. Any fee or cost charged in the process must be paid by customer upon delivery. Online purchases made through the Site are valid for exchange, credit, or refund within 15 days from the ship date.

Refund policy applies to all purchases made through the website www.ancoraswimwear.com/us and only applies for US and international orders. Refunds on sale products that are 30% off or over are not approved.

Refunds will be issued in the original form of payment. Please allow 2-3 weeks from the return ship date for your account to be credited, and 1-2 billing cycles for the credit to appear on your statement. For international cards please allow 4-6 weeks from the return ship date for your account to be credited, and 2-3 billing cycles for the credit to appear on your statement. 

If you made your purchase using a gift card, or store credit, refunds will be issued to the original card that was used. The refund amount will include only the amount paid by you after any discount or reward was applied to the returned item(s) and it will not include any shipping charge paid by you unless you are returning a damaged, defective, or the wrong item was sent to you.

All sale items that are 30% off or over, are final sale. Quantities are limited and are not eligible for exchange, refund or store credit. If you have a question about the sizing of a sale suit, please call customer service at [email protected] or [email protected].

On the checkout page above the Order Summary section, you may enter valid promo codes. ANCORA SM promo codes are case sensitive so please be sure you are entering them as they are. After you have applied your promo code, please make sure you see the code applied to your order in the Order Summary section before proceeding to checkout. Only one promotional code can be used per order. After an offer has expired, we are unable to give you the promotion on future orders. Additionally, current promotions are unable to be applied to previous purchases. All items purchase with a discount code greater or equal than 30% are final sale and are not eligible for exchange, refund or store credit.

ANCORA SM does not make adjustments to the prices in the event that any product goes into discount.

If customer receives a defective or damaged product, ANCORA SM is responsible for exchange costs and relevant shipments to replace the defective product. Please take into consideration that the request has to be made during the 15 calendar days after the purchase. You must also need to follow our care instructions.

If you receive a damaged or defective item, please notify us within 5 days of receiving your order and we will exchange the unwashed/unworn item for the same item at no cost. For any warranty, the product goes through a review process by ANCORA SM quality department. If it proves to be a factory error, ANCORA SM will proceed to return the product for the same reference as long as it is available. If the product for any reason is sold out, ANCORA SM will proceed to issue a store credit coupon for the net value of the product. This review may take up to 15 business days from the date of application.

ANCORA SM suits are made of the finest imported fabrics from Colombia and there are trims and appliances that are delicate in nature. Many of our suits are similar to fine lingerie and must be cared likewise.  ALL of the suits can be worn in pool or ocean water; however, they are not intended for arduous physical water activity or long periods of time in heavily chlorinated water. All swimwear should be hand washed separately in cold water with very mild soap (we recommend specialty lingerie detergent) immediately after use. Lie flat separately or hang to dry.

Purchase agreement

The contract between the user and ANCORA SM is perfected when the offer of purchase made by the user, is accepted by ANCORA SM. The contract will be governed by the terms defined in this document, which govern the purchase of products and/or services offered on this website.

ANCORA SM services are only available to those users who have legal capacity to contract, according to the United States legislation. If the user does not have legal capacity to contract, you may not use the site. In no case shall ANCORA SM be obliged to accept an offer to purchase.

ANCORA SM offers and extends to its users the invitation to purchase the different products and services that are stated and/or described on this website.

In order for ANCORA SM to consider a bid valid, it is necessary to comply with the following steps: enter the ANCORA SM page, select the products or services you wish to purchase, accept the Terms and Conditions of the page, fill in the customer personal data, select the payment method, fill in the data that depending on the payment method is requested, as well as any other information ANCORA SM deems necessary so that it can proceed to make the purchase.

Once approved and verified the payment, the offer is understood to be accepted by ANCORA SM. ANCORA SM approves the offer in the same process of payment of the user. However, at ANCORA SM discretion, it may accept or reject an offer.

Before submitting an offer to purchase, the customer must accept the Terms and Conditions of this website and additionally accept the terms of payment of the corresponding price, in accordance with the means of payment available.

ANCORA SM makes available to the customer a secure connection system for all the purchase offers, but in no case will ANCORA SM be responsible for the failures in the communications of banking or credit institutions, nor of the damages caused to the customers in the event of an action or omission of said entities. ANCORA SM offers payment platforms such as Paypal and stripe. Payment methods are those that each payment platform offers.

In the event that the price of the products and/or services subject to a purchase offer is not paid, it will be understood that there is breach of contract, which is cause for termination.

 

ANCORA SM online website www.ancoraswimwear.com/us uses Secure Socket Layer (SSL) encryption to scramble credit card information so that customer transactions are safe and secure. We accept the following forms of payment for online purchases through Paypal and stripe platforms

Customer must assume the shipping and insurance charges for the products and/or services that purchases at www.ancoraswimwear.com/us unless orders are eligible for free shipping.

Likewise, the customer is responsible for all sales taxes, value added taxes and any other taxes, duties and charges that are issued for each accepted purchase offer. All taxes caused will be settled at the checkout process and therefore, he can know the exact value that is paying expect duties on international orders.

We are required by the state of Florida to charge sales tax to any orders being shipped to Florida

The contract is understood to have been perfected with the offer acceptance by ANCORA SM. ANCORA SM may partially accept offers of purchase, in which case the contract will be perfected only for products and/or services accepted by ANCORA SM.

In the event of payment by the electronic payment platforms offered by ANCORA SM, in accordance with the conditions of this site, the property on the products and/or services will be transmitted to the user from the moment in which they are delivered and left the ANCORA SM facilities.

The products will be delivered to the address registered by the customer in the order made, and it can only be modified before the product is delivered from the ANCORA SM facilities to the customer’s address.

It is understood that the client and any person who is at the address where the delivery must be made is duly authorized to receive the order, and therefore ANCORA SM is exonerated from any responsibility for any order that is lost as long as it has been delivered to the address registered on the order.

If no one receives the order at the indicated address or no one is there at the moment of delivery, the logistics operator, after several delivery attempts, will proceed to return the products and/or services to ANCORA SM. Customer will be obliged to assume the expenses incurred to reship the order back to the shipping address registered in our site. Until the reshipping costs are paid, ANCORA SM will not be obliged to do the delivery again.

If the client does not proceed to request the reshipment within the indicated term or does not pay the additional costs for the reshipment, ANCORA SM may withdraw from the business, and will not be obliged to refund the amount paid for the products and / or services. ANCORA SM may generate a purchase voucher issued for use within the website, discounting the value of the expenses incurred
